I do get EEXIST in a few places:

directory)
stat64("/vicepd", {st_mode=S_IFDIR|0755, st_size=4096, ...}) = 0
mkdir("/vicepd/Lock", 0700)             = -1 EEXIST (File exists)
open("/vicepd/Lock/vicepd", O_RDWR|O_CREAT, 0600) = 6
close(6) 

I don't imagine that one matters much. I get one for each partition. Outside 
of that, there are no further EEXIST in the strace output, which is available 
at ftp://sukrahelitek.com/users/dative/strace.out.
