I'll hazard a wild guess, and predict that the problem is an unresolved 
symbol while loading the module, because we need to call refrigerator() but 
software-suspend- marks that symbol GPL-only.  I reported this 
problem some time ago, and the swsusp2 people fixed the problem in the 
source, but I do not believe is new enough to have that fix.

If this is indeed the problem, you will need to modify the swsusp patch (or 
the patched kernel) to change EXPORT_GPL(refrigerator) back to
