I had a similar experience, and ended up trawling through our tape =20
vault, and finding backup tapes of the first web server in North =20
America from January 1989. I had to document where and how they had =20
been kept, and then take them to a local large manufacturer of =20
mainframe computers where they still had the hardware and OS to read =20
the tapes.  I had to document every step, and answer a day and half of =20=

detailed questions about how the files were handled.

A useful source for you might be to find a backup tape from before the =20=

intellectual property case came to light.  It would be hard for the =20
other party to argue that you would go back and change the dates on =20
backup volumes from before you knew there was an issue.  Having =20
multiple backup tapes showing that the last changed dates on the files =20=

had been consistent and unchanging can be used to establish that those =20=

dates are credible evidence.  You should consult with your counsel =20
about how to establish the proper chain of custody of the evidence =20
before you touch any tapes.

Our evidence of prior art helped to have the patent thrown out, which =20=

is why the world doesn't have to pay a certain individual royalties =20
every time a web server does a backend search of a database.  We were =20=

able to show that someone at SLAC did it first and freely published =20
the technique.
